## 1. Privacy Policy

### 1.1 Data Controller

The controller of personal data processed through this website and project channels is FalconMobileCraft, headquartered at ul. Chmielna 10, 00-020 Warszawa, Polska. Privacy inquiries may be directed to [email protected].

### 1.2 Categories of Data Processed

When you dispatch a query through the contact console or enter a commercial relationship, we process: operator name, return email address, communications phone number, organization entity, selected service target, budget band, and mission brief content. Technical logs may additionally capture IP address, user-agent string, and timestamp data required for security auditing.

### 1.3 Purposes and Legal Bases

Contact parameters are processed to prepare a project proposal under Article 6(1)(b) GDPR (pre-contractual measures). Contract delivery, invoicing, and statutory accounting rely on Article 6(1)(c). Anonymous traffic metrics used to stabilize the console rest on Article 6(1)(f) — our legitimate interest in operating a reliable public interface. We do not engage in automated decision-making or profiling.

### 1.4 Retention Periods

Unconverted inquiry parameters are erased within 24 months of the last exchange. Client project records, source repositories, and financial documents are retained for the duration of the contract plus the statutory 6-year commercial-record obligation under Polish accounting law. Erasure requests are honored where no overriding legal retention duty applies.

### 1.5 Recipients and Processors

Data is processed on EU-hosted infrastructure. Limited disclosures occur to: payment processing via Stripe (card transactions only), email hosting providers under data-processing agreements, and App Store / Google Play vendor consoles when required for store submission. We never sell, rent, or broker personal data to advertising networks.

### 1.6 Your Rights

Under Chapters III and VII of the GDPR you may request access, rectification, erasure, restriction, portability, and objection to processing. Requests are dispatched to [email protected] and answered within 30 days. You may also lodge a complaint with the Polish supervisory authority: Urząd Ochrony Danych Osobowych (UODO), ul. Stawki 2, 00-193 Warszawa.

## 2. Terms of Service

### 2.1 Scope of Engagement

FalconMobileCraft provides cross-platform and native mobile application development, sensor integration, interface engineering, store deployment, and maintenance retainer services. Every engagement is defined by a written Statement of Work (SOW) specifying deliverables, milestones, turnaround windows, and fixed prices. Where an SOW conflicts with this document, the SOW prevails for that engagement.

### 2.2 Commercial Terms

Prices are quoted in USD unless stated otherwise. Milestone invoices are due within 14 calendar days of issue. Payments are settled via the published Stripe payment channel or bank transfer to the account specified on the invoice. Work on subsequent milestones may be suspended while prior invoices remain outstanding beyond 21 days.

### 2.3 Intellectual Property

Upon receipt of final payment for a milestone or full project, all worldwide intellectual property rights in client-specific deliverables — source code, design assets, and interface specifications — transfer irrevocably to the client. FalconMobileCraft retains rights to pre-existing frameworks, internal libraries, and generic tooling incorporated into the deliverable, licensed to the client on a perpetual, royalty-free basis for operation of the delivered application.

### 2.4 Client Responsibilities

The client warrants that supplied content, trademarks, and third-party materials do not infringe third-party rights, and that timely access to store accounts, certificates, and decision-makers is provided. Delays caused by missing client inputs extend delivery timelines day-for-day and do not constitute FalconMobileCraft non-performance.

### 2.5 Warranty and Liability

Deliverables are warranted to conform to the SOW for 30 days after final acceptance; latent defect reports within that window are corrected free of charge. Beyond mandatory statutory liability, aggregate liability under any engagement is limited to the total fees actually paid for the affected deliverable. We are not liable for indirect damages, lost profits, app-store rejection caused by platform policy changes outside our control, or third-party API deprecations.

### 2.6 Governing Law

These terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law rules. The courts of Warszawa shall have exclusive jurisdiction over any disputes, without prejudice to mandatory consumer protections under EU law.

## 3. Cookie Policy

### 3.1 Storage Mechanisms

This console uses browser localStorage and strictly necessary cookies to operate. The key cookie_accepted records your consent decision so the banner is not re-displayed on every session. No advertising cookies, cross-site trackers, or third-party remarketing pixels are deployed on this domain.

### 3.2 Inventory

cookie_accepted — type: localStorage — purpose: consent state persistence — duration: until cleared

session_token — type: functional cookie — purpose: security and load balancing — duration: session

_ga / _gid — type: analytics (if enabled) — purpose: anonymous traffic volume — duration: up to 24 months

### 3.3 Managing Preferences

You may clear stored consent at any time via your browser's site-data controls; the consent console will reappear on your next visit. Blocking strictly necessary storage may degrade navigation state but does not prevent access to core contact and documentation channels. For questions write to [email protected].

## 4. Refund Policy

### 4.1 Milestone Model

FalconMobileCraft delivers against milestone-based SOWs. Each completed milestone is invoiced on acceptance. Fees for a delivered and accepted milestone are non-refundable, as the engineering capacity has been fully consumed. Work-in-progress on a paid milestone that is cancelled before acceptance is compensated proportionally at the hourly rate stated in the SOW, and all work product to date is handed over.

### 4.2 Pre-Milestone Cancellation

If a project is cancelled before the first build sprint begins, any prepaid mobilization or discovery fee is refundable minus costs already incurred (third-party licenses, certificates, external asset purchases). Retainer months are refundable on a pro-rata basis only when cancellation is notified in writing before the next billing cycle starts.

### 4.3 Defect Correction

Verified non-conformities against the SOW specification are corrected at no cost within the 30-day warranty window defined in §2.5. A defect report is not grounds for refund once a corrective fix has been delivered and accepted, unless the defect is fundamental and unfixable within a reasonable number of attempts (maximum three cycles).

### 4.4 Consumer Cooling-Off

Consumers acting for purposes outside their trade or profession may hold a 14-day statutory right of withdrawal under EU distance-contract rules. Where services have already commenced at the consumer's express request within the withdrawal period, a proportionate payment is due for work performed up to the point of withdrawal. This clause does not reduce any broader mandatory consumer rights under Polish law.

### 4.5 How to Request a Refund

Dispatch a refund request to [email protected] with your invoice reference and SOW identifier. Approved refunds are returned via the original payment rail (Stripe or bank transfer) within 14 business days of approval. Invoice payments can also be settled through our Stripe payment channel.
